§ 1 User

§ 2 Scope
These general terms and conditions apply to all legal transactions between the user and a consumer (according to § 13 BGB of a "natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity").
§ 3 Conclusion of the contract
The provisions of these terms and conditions apply to orders that consumers place via the website www.hamsterbuy.com of the online shop Hamsterbuy.
The contract is concluded with the user (see § 1).
The presentation and description of the goods on the website of the online shop www.hamsterbuy.com does not constitute a contract offer.
By ordering goods by clicking on the “Buy” button at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is only concluded when the user sends an order confirmation by email and the consumer pays for the goods. After the purchase (click on the "Order" button) the consumer will shortly receive an order confirmation from the user with the request to pay for the goods and the expected delivery time. The contract is concluded after payment for the goods and successful receipt of the money on the account of the user.
If the consumer should receive information on the changed delivery time or price change from the user after the purchase, the consumer can withdraw from the purchase without giving reasons. In that case, the consumer does not have to transfer any money to the user's account.
§ 4 payment
The statutory sales tax is not shown separately in the invoice, as the user is a small business owner. According to Section 19 UstG (1), there is no obligation for small businesses to show sales tax separately. Shipping costs are not included in the displayed price and may also apply. The shipping costs are clearly marked in the shopping cart during the ordering process.
The following payment options are available to consumers:

- Bank Transfer
Depending on which payment option the consumer chooses, the information (bank details or PayPal details from the user) will be sent to the consumer by email after the purchase, together with the order confirmation. The consumer can use the information to pay the invoice amount.
§ 5 delivery, delivery restrictions
Unless the description of a selected product explicitly states otherwise, delivery takes place within 10 working days in Germany and within 15 days abroad. The delivery time may vary if the delivery company has problems with deliveries for unforeseeable reasons such as a pandemic.
In the case of payment via bank transfer or PayPal, this period begins on the day the money is received on the user's account.
§ 6 Transfer of Risk
The risk of an accidental deterioration or an accidental loss of the goods lies with the user until the goods are handed over and is transferred to the consumer upon handover.
§ 7 retention of title
The user reserves ownership of the goods until the purchase price has been received in full.

The statutory warranty regulations apply.
